Reform of the Permitting and Authorization Process in Construction: Key Amendments Proposed by the Ministry of Development
The Ministry of Development has released a draft Government Emergency Ordinance aimed at significantly simplifying urban planning and construction procedures. These reforms—crucial for accelerating both public and private investments—are structured around three main pillars: the introduction of tacit approvals, the sanctioning of delays, and the elimination of unnecessary bureaucratic requirements.

Extended timelines for permitting and authorization procedures, the request for additional documents not provided by law, and cascading approval requirements have caused significant delays in the implementation of investment projects.
1. Introduction of Tacit Approvals
According to the draft ordinance, if the relevant authorities fail to issue the required approvals or request clarifications within a prescribed timeframe, the approval shall be deemed granted by tacit consent. This measure is intended to eliminate blockages caused by the lack of responsiveness from public institutions.
2. Sanctioning of Delays in the Approval Process
Failure to issue approvals within the legal deadlines or unjustified refusals to grant approvals will be subject to fines ranging from RON 3,000 to RON 10,000. The State Inspectorate for Construction will have the authority to identify such infractions and impose the corresponding penalties.
3. Elimination of Additional Requirements and Cascading Approvals
The draft Emergency Ordinance stipulates that all necessary approvals and consents must be requested simultaneously. Authorities may no longer condition the issuance of an approval on the prior issuance of other approvals. Moreover, it is prohibited to request documentation exceeding the legally established requirements for the content of the files.
